  • Inheritor's Trust Services

    We provide the following services when hired to form an Inheritor's Trust for $2,500 and $750 for each additional Trust:

    1. Office consultations and phone calls to plan, design and sign the Trust.

    2. Preparation of an irrevocable Trust the purpose of which is to receive gifts and inheritance for the benefit of one specific person.

    3. Preparation of a Certification of Trust that can be given to third parties to prove the existence of the Trust, the name of the trustee(s), the name of the Trust, the date of the Trust and the powers of the trustee(s).

    4. Digital copies of the Trust and the Certification of Trust.

    5. Preparation of a "Crummey" notice to send to the beneficiary when gifts are made to the Trust.

    6. Obtain a federal employer ID number for the Trust.

    7. Prepare a summary of the Trust that explains to the beneficiary how the Trust works.

  • What is the full legal name of the person who is creating the Trust? The trustmaker cannot be the beneficiary. One one person is needed to create an Inheritor's Trust.
  • What is the trustmaker's mailing address?
  • What is the trustmaker's primary phone number?
  • What is the trustmaker's email address?
  • What is the name of the Trust? The name can be anything you desire, but we recommend that you do not put the name of the beneficiary in the name of the Trust.
  • What is the legal name of the initial beneficiary?
  • What is the beneficiary's mailing address?
  • What is the relationship of the beneficiary to the trustmaker?
  • Trustee Information

    The trustee is the person or entity that has legal ownership of trust assets and that is legally obligated to carry out the terms and conditions of the Trust Agreement.

    In this section we ask you to give the name and contact information for every person or entity who might be an initial trustee (appointed at the time the Trust is signed) or a successor trustee (after the death, resignation or removal of a then serving trustee.

    The Trust can have a single trustee or co-trustees.

    Please list every potential trustee below.

  • How many initial and successor trustees will be named in the Trust Agreement?

  • What is the mailing address of the first trustee?
  • What is the first trustee's primary phone number?

  • What is the full legal name of the second trustee?
  • What is the relationship of the second trustee to the trustmaker?
  • What is the mailing address of the second trustee?
  • What is the second trustee's primary phone number?
  • What is the second trustee's email address?
  • What is the full legal name of the third trustee?
  • What is the relationship of the third trustee to the trustmaker?
  • What is the mailing address of the third trustee?
  • What is the third trustee's primary phone number?
  • What is the third trustee's email address?
  • What is the full legal name of the fourth trustee?
  • What is the relationship of the fourth trustee to the trustmaker?
  • What is the mailing address of the fourth trustee?
  • What is the fourth trustee's primary phone number?
  • What is the fourth trustee's email address?
  • What is the full legal name of the fifth trustee?
  • What is the relationship of the fifth trustee to the trustmaker?
  • What is the mailing address of the fifth trustee?
  • What is the fifth trustee's primary phone number?
  • What is the fifth trustee's email address?
  • What is the full legal name of the sixth trustee?
  • What is the relationship of the sixth trustee to the trustmaker?
  • What is the mailing address of the sixh trustee?

  • Enter the name of the initial Distribution Trustee. The beneficiary cannot be the Distribution Trustee.

    The Distribution Trustee has the discretion to determine the amount and timing of all distributions of money and property from the Trust. We recommend that you name only one initial Distribution Trustee, but if you want to have co-Distribution Trustees serving at the same time enter all of the Trustees' names here. The initial Distribution Trustee should be a trusted family member, CPA, financial advisor or friend.

    The beneficiary will have the power to fire all Distribution Trustees and appoint a replacement Distribution Trustee. This power to fire and hire gives the beneficiary indirect control of the Trust's assets.

  • Who should become the first successor Distribution Trustee(s) if all of the initial Distribution Trustees cease to be the Distribution Trustee?
  • Who should become the second successor Distribution Trustee(s) if all the first successor Distribution Trustee(s) cease to be the Distribution Trustee?
  • The Investment Trustee has the power to control how the Trusts' assets are invested and used. For example if the Trust owed a home, the Investment Trustee could allow the beneficiary to live in the home rent free. If the Trust owned cash in the bank, the Investment Trustee could use it to purchase GM stock.

    Unless you want the Investment Trustee to be a trust company or a bank the beneficiary will be the initial Investment Trustee.

    This question asks who will take over as Investment Trustee if the initial Investment Trustee resigns or cannot serve for any reason other than death.

  • Who should take over as Investment Trustee if the initial Investment Trustee resigns or cannot serve for any reason other than death and the 1st successor Investment Trustee cannot serve?
  • Beneficiaries after the Death of the Initial Beneficiary

    The following questions ask who should become the beneficiary or beneficiaries of the Trust after the intitial beneficiary dies.
  • Who inherits the assets held in the Trust after the beneficiary's death?
  • If you selected "other" in the preceding question then explain who inherits the Trust assets after the beneficiary's death.
  • You Are Done
